Sod tear out and replacement with no herbicide

I have hired a contractor to replace my sod and he is going to remove the old sod with a sod cutter and add a layer of topsoil without tilling or using a herbicide.

I am a bit unsure about him not using a herbicide in case he leaves any roots from the weeds or the wide blade fescue that is in my current lawn.

Should I be concerned?

When I do a sod tear out I take out 2.5 " with my bobcat and then top up with topsoil then new sod. A sod cutter does not go deep enough.

What your saying makes sense but my contractor doesn't want to have to add to much topsoil since my lawn touches my neighbours. He is concerned that once it settles the lawns will be different heights. I'm more concerned about the wide blade grass resurfacing, but I've been told that as long as the new sod is thick and healthy I should not have a problem.
