| Warranty | The Contractor will correct, at its sole expense, any defect in the work due to faulty materials and/or workmanship appearing within a period of three years from the date that the entire project is completed. The Client will give the Contractor notice in writing of any such defect within a reasonable time, and in any event within the warranty period. All manufacturer warranties also apply on materials supplied by the Contractor for the duration of the manufacturer’s warranty period. The Contractor does not warrant labour and/or materials supplied by the Client or other contractors hired by the Client in connection with the work. The warranty only applies if the Contract Fees have been paid in full. The warranty is transferable to a new owner if the house is sold within the warranty period. The following types of defects are not covered by the warranty: Defects due to normal wear and tear. This includes but is not limited to defects related to normal shrinkage of materials that dry out after construction, such as nail pops, or scuffs and scratches to floors or surfaces caused by moving, decorating or day-to-day use of the home by the Client. Defects caused by improper maintenance. Defects caused by alterations, deletions, additions or other work carried out on the Client’s home by the Client or by other contractors hired by the Client. Defects caused by improper use, negligent acts, wilful destruction or vandalism. Defects caused by municipal services or utilities. Defects caused by fire or floods which arise as a result of circumstances beyond the Contractor’s control and/or not a result of substandard workmanship. Defects caused by lightning or natural disasters. Defects caused by insects, rodents or other pests If the Client elects not to proceed with the helical piles option, the Contractor will not warranty any defects related to further sinking of the foundation due to the ongoing subsidence issue at the back of the house, including cracks in the foundation. |
