Hired him to do an in-ground pool installation and some landscaping. He started the job in October and it is now June and it is still not complete. Has now stopped coming and is not responding to emails or phone calls. Paid for most of the project and he has taken off with my money.
Has left a mess in my yard and a pool with no concrete bottom, no liner, no pool equipment. All aspects of the landscaping have been started but nothing has been completed.
Elio contacted Graham Pools & Hardscapes on Sept 19/2012 to install a 16x26 Inground Swimming Pool w landscaping & two concrete pads. One for a Large shed and the other for a Hockey rink.
Throughout the quote process the realization was made that his wants far exceeded his budget. In order to meet the demands of the project and meet his budget he was to assume the responsibility of some of the tasks. We were given a price range to complete certain tasks throughout the project and he was to be the General Contractor & co-ordinate his end seamlessly. We agreed on a price and a contract was drawn up. He wanted the contract structured to allow for him to pay for the project by cash but pay the tax in the end & any extras were to be discussed at the time of installation and be payed for at the end of the project. He seemed like a fair person and we were willing to work with this customer in order to provide him with the labor & skill to complete a project of this size.
October 12 2012 we came to an agreement but he wanted a few days to look over the contract. he was happy to provide a deposit to secure a place in the schedule. We were to start on October 17th but due to rain & Hurricane sandy we put the start off for a week.
The project started with a bang but we soon realized Elio was slacking on a number of his responsibilities and was asking our contractors to do extra favors while they were there and then making changes to the project plans and complain that he couldn't get anyone to help.
I sat him down after the first couple of weeks and we straightened out some issues regarding his interruption of the workers while they were on site working. Extras and his role and responsibilities.
Two weeks into the project a Building Inspectors shows up on the site and puts a stop work order on the project because Elio Failed to go get all the necessary permits and because he had not yet received a final inspection on his previous permit from the full renovation of his house years earlier and only received a Final inspection the last week of May 2013 on work that he was to complete.
This held us up for the majority of another week then the time came to dig the Pool and Elio discovered that he had measured wrong and the Structure for the Hockey rink was bigger than he first thought which meant we had to alter the size of the Pool that had been manufactured packaged and ready to ship. Another week hold up while we waited for the kit to come in.
Elio's responsibility was to Prep the Chiller lines in the Hockey rink pad. This took a total of 8 weeks after the Final prep was completed on the base and to this date still is not complete in order for us to install Concrete Pad.
During this time in order to keep the project rolling we continued to install the interlock. This was done against our best interest and only to try to facilitate getting the job done before Christmas. It was soon apparent that the Job was to be held off until the spring.
We had gained access through the neighbors yard in order to do the work and were to restore the yard on our way out. the neighbor was more than co-operative after we had offered to erase some extras that he had asked for So as compensation for being without a back yard for a longer period of time we agreed the neighbor wouldn't pay anything extra.
Elio came to Us in the spring stating that he was having some money problems and that the extra's he would need some time to pay them off but was not willing to pay for all the extra's. We then offered a discounted rate of almost $10,000 less than the Grand Total from all the Extra's given that he had referred us to his Brother In-law and another neighbor.
He then stalled for a few weeks and Offered only a minor portion of the extra's. We rejected and here we are!
We had offered to settle this dispute but Elio has resorted to harassment and stalking. We are now in the Process of obtaining a Peace Bond and looking to resolve this in Court.
