Next door neighbour is having a residential contractor do work but needs access to my property to fix her issues. Is there something to protect me if he falls and tries to sue me?
Since everyone is making bogus slip and fall claims, how can I protect myself?
The contractors coverage only covers the home he is working on. His W.S.I.B is for the house he is contracted for. Your next door neighbor signed the contract making the contractor and him covered under WSIB. You are not.
He either signs a waiver that you are not responsible for an accident occurring or a new contract is drawn up to include your home under your neighbors contract.
Hi,
Jeffs comment is correct.
I would go a little further and state that any movement on your property of persons, material or equipment is the sole responsibility of the contracting company who is working next door.
I would also insert a clause that stipulates any damage or mess on your property will be cleaned or repaired by the contracting firm working next door.
As a contractor, I would hate to claim to be an expert in answering your question. If it was me, I'd ask a lawyer.
