About 5 years ago, we had our attic cleaned out, replaced with new insulation and rat proofed. Last year we had a new roof put on the house. Now, there are rats living in the attic again. It will cost us $4,000 - $5,000 to redo the attic---sanitize, seal up holes and replace insulation all over again. Should the roofer have been responsible to make sure that there were no gaps so rats couldn't get in the attic? Should they be liable for the cost we now have to pay someone to redo the attic?
Unfortunately the roofer will not be libel. Roofers are not pest control and it is not generally in their work perview to do such things. The only way they would be libel for it is if it was stated in the contract that they would take the steps to do the extra work for pest prevention.
