I have question regarding egress window for basement apartment. I have seen maximum sill height require for basement egress window for nation wide is 44" and for Ontario need 39". Is it right?
Please clarify this. Note sure about it.

I'm what the majority of inspectors look for. However I have done many of these windows for basement apartments. A quick phone call to your building official is what I would recommend. There are a couple different scenarios that can affect it. Also take into account if you need a window well on the exterior of the house.

The numbers you've provided are correct for the egress windows that are above grade. Ontario Building Code (OBC) allows for an exception when it comes to an egress window located in a basement.
Article 9.9.10.1 of OBC specifies that there are no minimum sill height requirements for a basement egress windows, however it is advised to locate the window not higher than 1.5m above the floor.
