I bought a house that was listed as built in 2015, as soon as I looked in the attic, I noticed mold. I called my insurance company and they sent someone out to look at it. They said there was no problem and it wasnt mold.
My toilet in my upstairs bathroom leaked thru my living room ceiling. I got a plumber to repair it he said they used a cheap wax seal and it wasnt thick enough.
All of my gutters leaked causing damage to the decks. I called insurance they said that wasnt covered. I replaced the gutters. I have a water heater from 2013 even though my house was built in 2015 the plumber told me I need to replace that and there's no pressure gauge and my upstairs is over pressurized. My neighbor told me that there was a flood in my basement prior to me moving in, that was never disclosed. Half of the heaters in my house don't work that was never disclosed.
All the floor boards are warping, I'm assuming from moisture. My mother complained of a musky smell in the basement when she moved in.
At this point I noticed water leaking thru my upstairs bathroom roof, so I went and looked in the attic again. Now the mold is growing hair and changing colors. So at this point I call a mold removal company, they quote me at 30k-70k after all the mold is removed as I will probably have to replace the plywood on the roof and hire roofers to do that not to mention the mold remediation, and thats just for the attic and walls. He took a look at my living room hole, n said the beams there are so rotted that it looks like its been leaking for a very long time. I told him the house was 2 years old he said I dont know about that. I looked on google maps, the house was standing in 2011.
The basement is rigged up for 200 amps of power and so is the upstairs. My friend found that very odd as they said they put the downstairs in after building the place but you can see the power has been ran in 2011.
At this point I'm 1.5 years into owning this mess. I went to the hospital because i couldnt breathe prior to finding the mold, my lung function is at 69%. I never had asthma prior, now im on multiple inhalers and steroid pills for my lungs. My dog is also having problems.
I went and seen a lawyer, he quoted me 100k for the case. He said I have a case against the seller, the builder and the owner, and possibly the real estate agent if i can prove he knew about any of these problems prior.
All of these options are too expensive for me. I'm at a loss for words that someone can get away with this.
Has anyone dealt with something similar? As the lawyer said even if I sue there's a good chance none of them even have my money anymore.
Please help!
You need to contact your insurance company right away and ask them to send another adjuster to inspect your home and tell them that you had a previous file with them and the adjuster at that time denied you a claim for the mold you found. You need to show the new adjuster all the issues in your home now so a restoration company can come over and start dehumidifying your home and get to work. Get a statement from your neighbor about the mention of your basement being flooded. You will obviously have to pay a deductible to get your home fixed and the cause of the house mold will also probably not be fixed by the insurance company. So now you will need to hire a lawyer and have them make a letter to your realtor who should have disclosed this info to you that you are suing them for this amount of dollars for the expenses that you had to endure that the insurance company didn't cover to get get your home in working order. As your home was supposed to be in working order when you moved in, instead you were left with home issues that affected your health and stress and more repairs. Good luck!
