Yes, you don't need anything to lien a property.
It just makes it harder to proof in court without a contract.
If there's written communication (email / text) before and during the job then I don't see why not. That is effectively an agreement and should hold up similar to a contract.

I am no expert but have studied construction law. Registering a Lien on a property is a legal process to which you would need proof of some form of agreament wether it be a contract or emails or text messages. The contractor must have proof that the home owner is in breach of contract.
