Do I have to pay a contractor who does bad a job

Hello,

I hired reputable contractor to re do my driveway and than widen it. Contractor was very approachable and responsive. It took a few months, but they came, prepped the driveway, but forgot to widen it. I asked him to come back. It took another 2 months. He widened the area( about 2 feet), but instead of using more gravel, he scrapped some of the existing gravel of the prepped area and moved it to the extended area. The extended area is pretty soft. Now. What do I do? How can I trust him to complete the driveway properly and make sure he wont cheap out on the asphalt. Also, is it too late laying ashpalt in November? Finally how can I make sure they will put 2inch of compacted asphalt. Is it possible to prep the area and lay asphalt same day ? Or do I have to wait another 2 weeks for the gravel to settle ?
