Existing insulated walls, new permit

I am looking at estimating a finishing a basement. Not too complicated, but the builder framed the foundation walls (top to bottom), including adding insulation and vapour barrier. No drywall. When the builder completed the house building code was R14.

The owner has taken out a new permit for finishing the basement.

Question: Will the walls have to be brought up to R20 as a result of the new permit?

The Answer Is No If You remove the Insulation and Find there's A Moisture Barrier Tyvek. Typar Then go ahead with it. If there is No Moisture then I'd advise you to look at my previous posts on how to properly Insulate Your Basement.

The original permit was closed by the builder so you may be required to upgrade because it is not a finished space. This will be up to the examiner but the new code is in place for new building and because the basement was not finished it may be considered new construction.
