Hot tub wiring permit

Hi, I have done extensive landscaping work in my backyard. At the time of the construction, i had run conduit and poured a concrete pad in case in the future i wanted to add a hot tub. 4 years later, my wife now wants a hot tub. At the time of the landscaping (1200 sqft of interlock), we never got a trench permit. Some electricians said they cant get a permit to run wire without one. I cant jackhammer out the concrete and pull out all the stone. will the ESA work with me or is there any special type of wire that doesnt need to be 18" in the ground?
