Landscaping gone bad

In April 2015, I had my entire walkway done in stone. Throughout the winter,the walkway sank. It turns out that the sand is leaking out the sides and causing this problem. All the steps are sinking. I've been in contact with the landscaper and for the last 2 months, I've heard "I'll be there tomorrow:" and then he doesn't show up and not text/call to explain why. This has been an ongoing thing. I have all the texts that prove his negligence and pictures to show all my problems. I'm now done waiting for him.
What can I do? Is there steps I can take before going to small claims court?
