So I have a contract that specifically stated "remove old roofing material to bare wood." The workers refused because it was too hard and taking too long. (They were stuck to the ice and water). I tried contacting the contractor, he did not return my calls. the workers went ahead and shingled over the existing. (I have pictures throughout the process).
The next day, the contractor contacts me looking for payment in full. I said you didn't fulfill the contract. He said it would have taken too long. I don't understand the contracting business... etc. After a debate, I wrote him a cheque for 1000$, aprox half of the total owed. He wrote up an invoice for the whole amount, mistakenly(?), and put it in my mail box marked "paid in full."
Today I get a call from his accountant saying that the amounts don't match and that I need to give her a cheque for the whole amount.
What can I do ? What can he do? I am young, this is my first home and first time dealing with a contractor.
Good Afternoon,
Sorry to hear about this situation. In my experience dealing with contractors like this if they keep bothering you for full payments then you should go to a small claims court. They did not comply with the contract and charging you for removing old roof is not fair. I suggest to come to an agreement with the contractor and tell them not to charge you for removing old roof. Installing new shingles over the existing roof makes your new roof less durable. It takes away half of their durability so if you have a new roof over existing and it will last you about 4-5 yrs instead of 7yrs or whatever they tell you.
Hope for the best, keep us posted to what they say or what they are going to do. There are many ways to handle this situation but in your defense they did not complete the job and charging you extra for demolition and garbage its not fair.
