| Warranty | a) The Company provides a 30-Day warranty on all plumbing materials used and a 1-Year warranty on all plumbing workmanship, except for situations described in this section. b) No warranty is provided for any landscaping work, including, but not limited to, soil reinstatement, grading, reinstatement of lawns or gardens, or the reinstatement of any decks, fences, or other non-plumbing related structures. c) No warranty is available for any non-plumbing related trade work such as carpentry, drywall, electrical, etc. d) The Company shall not be liable for any loss, damage or injury to any person or property resulting, directly or indirectly, from the possession or use/misuse of installed Materials or its accessories, whether or not such loss, damage or injury is caused by negligence. e) The Client understands and acknowledges that, among others, the following breakages, failures or damages are not covered under this warranty: i) Damages caused by the use or modification of the installed Materials, or its accessories, for purposes other than those intended by the manufacturer; ii) Damages caused by negligence, accident, collision or otherwise by the Client or by a third party, fortuitous event, or force majeure. The term “force majeure” shall mean a serious and unforeseeable event, external to the parties of the Agreement including but not limited to a pandemic, a declaration of war, or an Act of God, being an uncontrollable natural event not caused nor controlled by humans. f) The Client agrees and hereby undertakes to indemnify and hold the Company harmless from and against any liability to third parties and to indemnify the Company for any damages, losses, legal or other costs and fees the Company may incur as a result of, caused by, or in connection with the possession, use and/or operation of the installed Materials or its accessories by the Client. |
