Contractor four months past agreed upon deadline

We hired a contractor who totally screwed us over. Took quite a bit of money up front and then left. We filed a lawsuit. Hired second contractor, who has done a good job, but is four months after the deadline (mentioned as November 2018 in contract) and just needs to finish punch list. However, he is unwilling to compensate us AT ALL for the four months. We are paid up to date to him at this time. What can we do?

Sorry to hear that you guys are going through difficult times getting your renovations done.

Was there a contract done for both parties.

Yes. It is very clear that we are to pay a certain fee for the labor, and the materials are mapped out with an added 10% for his cut. In the contract, it says that 'we will do our best to get the barn built by end of November (2018). Barring any bad weather, we see no reason it cannot be done by then'. We are now in March, almost April. It is almost done, and they have done a nice job and we are paid in full to him except the final payment. We have asked for some compensation (we thought he was going to build an inside wall for us, but it is not IN the contract, we talked only, so we asked him to build that as the compensation) but as of right now, he is refusing to do anything and blames the lateness on weather. He also let his guys go for over a week in November (when the barn should have been completed) to go deer hunting. We just think we deserve something. Very frustrating.

Theee isnt much you can do unless late penalties are detailed in the contract. Never pay in full until the project is complete. Progress payments are acceptable and final payment upon completion to your satisfaction.

He is not obligated to compensate you otherwise. However, he also lacks integrity & an ethical conscience.

Just let him finish, get him out & hope nothing goes wrong.
