I wont bore you with details, but here's a very brief summary: I hired a contractor to do a job that he estimated would take a day or two. After a laundry list of excuses and weeks later, it's still not done. This was an all-in estimate (I insisted on it, in writing and the all-in quote was in writing).
Long story short, I've already paid around 85% of the estimate over the weeks this dragged on (I am judging myself too, don't worry ... but I really didn't have much of a choice because I was desperate to get it done).
I don't think 15% remaining is enough of an incentive for him to finish the job, so now he wants more money for material because "I spent way more on material than anticipated, but I can't prove it to you because I don't have receipts for anything".
I am ready to file it under "lessons learned" and take a loss, but without my permission he left a ton of tools / wheel barrow (and dirt) in my garage. He wont move the dirt, but I do need him to remove his tools so I can get the use of my garage back. I've already asked him, but he refuses, insisting that I need to agree to pay more so he can come finish the job at once.
So, question: can I just give him a 3 day notice to remove his stuff and then leave his stuff outside? I have no interest in keeping his tools hostage, I just want them off my property (especially since I never agreed to him leaving his stuff in my garage. He just did it without asking). I suppose I should ask a legal forum :-), but since you're all in trade I figure you might have some experience with it.
It seems its just a small job and you do not have to waste your time and get yourself tired of stay thinking of what you have to do on this. Try to call him and let him come over, do a quick agreement and let him finish the work based on that in a firm way
