What to do when new furnace fails inspection?

I hired an HVAC guy to replace a furnace. The permit was pulled, I checked. However the inspection has failed twice now because the vent is not 4 ft from the property line. This house is now sold and the new owners take possession in 5 days. The HVAC guy just doesnt seem to care. I'm out of time.

What should I do? He has been paid and we have a signed contract.

Furnace was installed 6 months ago. Is there a time frame that they are accountable for, to the failed inspection?
